Our Commitment to Privacy
ADVANCED COMMERCIAL CAPITAL, INC. ("ACC") is committed to maintaining the confidentiality and privacy of the information we obtain about our clients, prospective clients, and former clients. In the normal course of our business, we obtain, maintain, and use business and financial information about our clients and those who apply to use our factoring services, as well as the principal owners of those businesses, and we will do everything in our power to ensure your right to privacy.

ACC does not sell or share client, prospective client, or former client information to mailing list brokers, marketing firms, or other third parties for their own marketing purposes.

The Information We Collect
In the course of serving our clients, ACC acquires, stores and transmits personal and non-personal communications and information that clients may regard as private or sensitive. Some of this information - such as the client's name, address, telephone number, email address, bank account, and historical business data - is provided to ACC by its clients and prospective clients on application forms and other documents in order to establish service. Other information - such as the customer's account status, choice of services, transaction data, and customer logs - is created and maintained by ACC in the normal course of business. In addition, ACC may store clients' electronic mail and other communications as a necessary incident to the transmission and delivery of those communications.

ACC also collects information about clients and prospective clients from a variety of third-party sources, which may include but are not limited to financial institutions, credit reporting agencies, account debtors, government repositories, and taxing authorities.

The Way We Use Information
ACC will use the information it obtains, whether it originates from a client or prospective client, or from a third party, to provide clients and prospective clients with accurate estimates or quotes for our factoring services, as well as to provide information about products or services which might be of interest to clients and prospective clients. We will also use client information to provide notice about ACC office closures for holidays and changes in hours of operation. ACC may also use client information to provide its clients with system information or information about necessary system upgrades.

ACC will review, delete or block access to information or communications that may harm ACC, its clients, employees, or third parties. The grounds on which we may take such action include, but are not limited to, actual or potential violations of ACC's Terms of Service or Acceptable Use Policy.

Use of Cookies and Action Tags
ACC uses cookies, which are small pieces of information that a web site can store in a designated file on a user's computer for various reasons. We use these cookies to track activity on our website, to serve relevant ads to visitors on our website, and to more effectively provide our services to our clients and prospective clients. In certain cases, we also implement the use of action tags (also known as single pixel gifs or web beacons). Action tags are tiny, invisible images that are placed in certain areas of a website. When a tag is triggered, the request is logged in an external system and is linked to the cookie ID of that user. Any information collected via cookies and action tags is completely anonymous.

Security of Data
ACC will protect the confidentiality of its clients' information, account information and personal communications to the fullest extent possible and consistent with the law and the legitimate interests of ACC, its partners, its employees and other clients. To protect the loss, misuse, and alteration of information that is collected from clients, prospective clients, and former clients, ACC has appropriate physical, electronic, and managerial procedures in place to protect information including but not limited to data encryption, physical access security, and employee access controls. We continually monitor and, as necessary, enhance our security systems.

Opt Out & Modifications
Clients may opt out of receiving notices of new or enhanced services from ACC by contacting us by phone or in writing. However, clients may not opt out of receiving information from ACC which is essential for maintaining or updating clients' accounts, system information, or information relating to transaction data resulting from clients' use of our factoring services.

Disclosure of customer information and communications
ACC will not disclose its clients' personal and account information, except in limited situations, unless ACC has reason to believe that disclosing such information is legal and necessary to identify, make contact with, or bring legal action against someone who may be causing harm or interfering with the rights or property of ACC, our clients, or others, or where ACC is required by law to make such disclosures. ACC also will not, except for reasons stated below, disclose to third parties any clients' information or other electronic communications that ACC stores or transmits for its clients. The circumstances under which ACC will disclose such client information are when:

1. It is necessary in order to provide service to the client, such as disclosures necessary to effect, administer, or enforce a transaction requested by the client;

2. It is necessary to protect the legitimate interests of ACC and its clients and to prevent fraud;

3. It is required to cooperate with interception orders, warrants, subpoenas, or other legal process that ACC determines in its sole discretion to be valid and enforceable; and

4. It is necessary to provide to a law enforcement agency when the information is inadvertently obtained by ACC and appears to pertain to the commission of a crime.

Additionally, ACC is permitted under Federal law to disclose confidential client information and transaction data to certain recipients, such as credit reporting agencies. Other recipients of information disclosures may include financial institutions, companies that process transactions or provide other services for us, or government agencies.
